Terms & Conditions of Carriage
These Terms & Conditions govern the contract of carriage between Mustang Equine Transport Ltd (“the Carrier”) and the person or organisation booking transport (“the Consignor”). By booking transport, the Consignor agrees to be bound by these Terms & Conditions.
1. Definitions
- Carrier: Mustang Equine Transport Ltd, including its employees, agents, and subcontractors.
- Consignor: The owner of the horse or any person or organisation booking transport.
- Horse / Goods: The horse(s) being transported together with any tack, equipment, or property supplied by the Consignor.
- Receiving Location: The place where the horse is handed over to the Carrier.
- Delivery Destination: The agreed destination where transport is completed.
- Horsebox: Any vehicle or trailer used by the Carrier for transport.
- In Transit: From the time the horse is handed to the Carrier at the Receiving Location until unloading at the Delivery Destination.
2. Duty of Care & Limitation of Liability
The Carrier will exercise reasonable care and skill in the transport of the horse.
The Carrier shall not be liable for loss, injury, delay, or damage arising from:
- Events beyond its reasonable control (including traffic incidents, adverse weather, road closures, breakdowns, or acts of third parties);
- The natural behaviour, temperament, condition, or actions of the horse;
- Any illness, injury, or death occurring without negligence by the Carrier.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, or any liability that cannot lawfully be excluded under English law.
3. Insurance
The Carrier does not provide insurance for the horse.
It is the responsibility of the Consignor to ensure that adequate insurance is in place for:
- Loss, injury, illness, or death of the horse while in transit;
- Any equipment transported with the horse.
4. Veterinary Treatment
In the event of illness or injury during transit, the Consignor authorises the Carrier to obtain emergency veterinary treatment where reasonably necessary and in the horse’s best interests.
All veterinary and related costs shall be the responsibility of the Consignor and reimbursed to the Carrier if paid on their behalf.
5. Cancellations
- Cancellations must be made at least 72 hours prior to the scheduled collection time.
- Deposits are non-refundable once paid.
- Any additional sums paid in advance beyond the deposit will be refunded if cancellation is made within the required notice period.
- Late cancellations or non-attendance may result in full charges being payable.
6. Loading & Unloading
The Consignor is responsible for safely loading and unloading the horse at the Receiving Location and Delivery Destination.
Where the Carrier assists with loading or unloading at the Consignor’s request, such assistance is provided without acceptance of responsibility, except where damage or injury arises from the Carrier’s negligence.
If a horse is unable to be loaded due to behaviour, temperament, lack of preparation, or unsuitable facilities, this shall be deemed the responsibility of the Consignor and no refund is guaranteed.
7. Damage or Injury Caused by the Horse
The Consignor shall be liable for:
- Any damage caused to the horsebox or equipment by the horse;
- Any injury or loss suffered by the Carrier’s employees, agents, or subcontractors caused by the horse,
except where such damage or injury results from the Carrier’s negligence.
8. Manner of Carriage
The Carrier retains discretion over the route, timing, personnel, and method of transport in order to safely and efficiently complete the journey.
Specific requests by the Consignor may be considered but may incur additional charges and may be refused where safety or practicality would be compromised.
9. Amendments During Transport
Any requested changes to collection points, destinations, or transport arrangements may be subject to additional charges or refusal where impractical.
If the Consignor does not agree to additional charges required to fulfil amended requests, the Carrier reserves the right to terminate the contract. Refunds (if any) shall be limited to sums not already incurred.
10. Additional Charges & Waiting Time
The following form part of these Terms & Conditions:
- A maximum of 15 minutes is allowed for loading.
- Additional loading or waiting time will be charged at £20 per hour plus VAT, calculated pro-rata.
- Unplanned waiting or loading charges must be paid on the day, via cash or bank transfer.
11. Timings
While the Carrier will endeavour to meet requested timings, times cannot be guaranteed due to factors beyond reasonable control including traffic, delays at other collections, or loading issues.
Where possible, drivers will provide approximately 1 hour’s notice prior to arrival.
12. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Agreement
By booking transport with Mustang Equine Transport Ltd, the Consignor confirms that they have read, understood, and agreed to these Terms & Conditions.
